Photographing and Videoing Children in Sport

FNSW Logo 100x100In Australia, generally speaking, there is no law restricting photography or videoing of people (including children) in public areas as long as the images are NOT:

          • indecent ('upskirt' or 'downblouse' photographs taken covertly);
          • being used for voyeurism;
          • protected by a court order (e.g. witness protection, child custody, Ward of the State);
          • defamatory; or
          • taken for commercial purposes (a person's likeness is used to endorse or entice people to buy a product).

If an individual is believed to be photographing for inappropriate purposes, discuss with a team or Club official. The Club can request the individual to stop. If the individual refuses, the Club may contact police to deal with the matter.

There are no restrictions on parents, guardians or family members taking photos or video footage of their children or relatives participating in football provided the images are for personal use and are not inappropriate. Equally, there are no restrictions on officials (coaches, referees or administrators) taking images for coaching purposes, professional development or general publicity.

Where a professional photographer or videographer has been engaged by a Club to acquire images of individuals or teams for the purpose of selling images to participants or interested persons, the Club requires the contractor to be suitably identified and must have provided a current WWC Check Number (as issued by the Commission for Children and Young People) to the Club for verification.
